What is personal data?
According to the GDPR, “personal data” means any information concerning an identified or identifiable natural person (“data subject”). An identifiable natural person is a person who can be identified, directly or indirectly, in particular by reference to an identification element, such as a name, an identification number, location data, an online identifier or one or more specific elements of his physical, physiological, genetic, mental, economic, cultural or social identity.

There is no list of personal data, and the GDPR does not require states to make such a list, for the simple reason that a date may in one context become personal data and in another context be simply a information without value of personal data.

Here are some examples of personal data:

  • the name;
  • one’s domicile or residence;
  • an e-mail address (including addresses such as andrei.popescu@firma.ro);
  • ID card, passport or ID number;
  • location data (for example, the location data feature available on a mobile phone) *;
  • an IP;
  • a cookie ID;
  • the silhouette of one of the CCTV recordings;
  • a registration number of a car;

As can be seen, the definition of personal data also contains some important elements:

Personal data refers to information about individuals, not legal entities. The distinction is important because, for example, the registration number from the Trade Register, the Fiscal Code or other identification elements of some companies are not personal data. Moreover, when an e-mail address or a telephone number clearly targets a legal person (eg office @ e-mails or telephone calls from a public call center of a company), then we are not talking about about personal data.

It does not matter whether the processing of this personal data is done through an automatic system or through a non-automated system (eg manual processing), if it is part of a structured data record system. The only important thing is that we are talking about processing such data.

More information for understanding what personal data are can be obtained by reading Opinion no. 4 of 2007 on the concept of personal data, issued by the Working Group Article 29.

Simplifying the above definition, we could conclude that personal data means data that refers to a living person who can be identified using this data or starting from this data and using additional information that is or may be in the possession of the data controller.

The information we collect
ARONIA-CHARLOTTENBURG.COM collects personal data in two important ways:

Information provided directly by you, through the forms ARONIA-CHARLOTTENBURG.COM (for example, as a result of registration as a member of the community ARONIA-CHARLOTTENBURG.COM, as a result of requesting a service ARONIA-CHARLOTTENBURG.COM, as a result of orders placed on site or as a result of subscribing to the newsletters ARONIA-CHARLOTTENBURG.COM).

Information that we obtain when you use our services (for example, we process the history of your interactions with our newsletters in order to understand and limit the newsletters to those that interest you, the history of your orders, etc.).

Data provided by you, directly

ARONIA-CHARLOTTENBURG.COM uses forms through which you can create an account, you can order, you can leave reviews or you can register for the informative newsletters ARONIA-CHARLOTTENBURG.COM. These forms include fields such as name, email address, cell phone number, password, product delivery address details, billing details, and more.

We use this data to allow you the access to the site and to be able to deliver the products and services you have chosen to receive (the ordered product, newsletters, etc.). The legal basis for this processing is the entry and execution of a contract to which you are a party (whenever you perform the above operations, you agree to the terms and conditions of providing those services) or your consent, if we talk about making commercial communications to you, without mentioning similar products and services that you have already purchased from us, where we are entitled to send you commercial communications (but we will continue, permanently, to offer you the opportunity to unsubscribe from that kind of communication).

We may also need to request tax additional information if we are required by law to file tax returns in connection with the products and services you order. In that case, we will refer to your address (necessary to be entered on the tax invoice), but also other tax data that the law requires us to collect and process in connection with the transaction in question. In this situation, the legal basis for processing will be the obligation to comply with the provisions of the legislation.

We do not use your data to send marketing communications unless you explicitly opt for such communication. Even in such cases, we assure you that you have an easy-to-use option to unsubscribe (withdraw consent) at any time, either in the communication itself or by contacting us by email or phone.

ARONIA-CHARLOTTENBURG.COM also offers the possibility to send us a message. The data you send following the use of this contact option is processed on the basis of our legitimate interest in responding to your request and / or keeping a record of your complaint, request for advice and the like. This data is stored for 5 years.

Cookies and other similar technologies
In the early days of the Internet, sites had no memory. Thus, in the first variants of sites, it was not possible to authenticate visitors or use aids such as shopping carts, online stores or other mechanisms that help the user and the site to recognize other visits.

Cookies were invented precisely to fix this problem. They are small text files, placed on a visitor’s terminal, which act as the site’s memory. Whenever the person in question accesses a certain site, he can write or read in the cookie he placed on the terminal all kinds of information that the visitor has already sent to the website, directly or indirectly. Subsequently, other technologies have been developed here that aim at the same type of purpose. We have tried to describe each such technology below.

Cookies are small text files placed on your computer or mobile device when you visit websites. “Direct” cookies are set by the domains you are currently visiting (eg ARONIA-CHARLOTTENBURG.COM). “Third party” cookies are set by domains other than those of the sites you visit (eg domains other than ARONIA-CHARLOTTENBURG.COM).

The mobile ad code is a unique identifier (ID) set by your mobile device’s operating system. This ID helps apps that you install on your device that may contain ads to recognize you. Most devices allow applications to access their mobile advertising ID by default. However, you can change your device settings to prevent your device from sharing this code with various applications. Check the “Help” section for operating systems to learn more about managing mobile advertising IDs. On Android, Advertising means the Android Advertising ID, on iOS devices it means the Advertiser ID (IDFA).

What rights do you have, as a user of ARONIA-CHARLOTTENBURG.COM?
The regulation recognizes a number of 8 important rights for data subjects (the operator is the one obliged to ensure their observance):

  1. The right to information – art. 13 and 14 GDPR. It allows the data subjects to know, right from the moment the collection is made, how those data will be used, to whom they will be disclosed or transferred, what rights the persons concerned have regarding the processed data, etc.
  2. The right to access data – art. 15 GDPR. It allows you to obtain, from us, a confirmation that we process or not personal data concerning you and, if so, access to that data and other useful information.
  3. The right to delete data – art. 17 GDPR. It allows you to obtain from us the deletion of personal data concerning you, without unjustified delays. There are, however, exceptions to this rule, such as the idea that some data is processed to give the public the right to information, that it is processed for statistical or archival purposes, that it is processed to fulfill a legal obligation or that we process it for finding or defending a right in court.
  4. The right to data rectification – art. 16 GDPR. It allows you to obtain from us, without unjustified delays, the rectification or completion of inaccurate personal data concerning you.
  5. The right to data restriction – art. 18 GDPR. It is a temporary right. In some cases, between the time we, for example, make the decision to delete certain data (we no longer need personal data for the purpose of processing) and the actual deletion of data, you send us a request opposing the deletion, motivating the fact that you need this data to establish, exercise or defend a right in court. As a result of such a request, we will “freeze” the data by stopping its processing for a certain period of time.
  6. The right to data portability – art. 20 GDPR. You have the right to receive personal data concerning you and which you have provided to the operator (who processes them under a contract or with your consent, by automatic means) in a structured, commonly used format and which can be read automatically and you have the right to transmit this data to another operator, without obstacles from our side. In other words, your personal data will be provided to you, in a structured format, so that you can decide to download it or, on the contrary, to send it to another operator.
  7. The right to opposition – art. 21 GDPR. You have the right to object, for example, to the processing of your personal data when they are processed for direct marketing purposes. In order to be clearer how you can exercise this right, it should be mentioned, for example, that in all newsletters that come from ARONIA-CHARLOTTENBURG.COM (whether we are talking about newsletters that offer only information or newsletters that promote services or products ARONIA-CHARLOTTENBURG.COM) you will always have the opportunity to unsubscribe. We offer this possibility in absolutely all situations, regardless of whether the law obliges us or not (not all emails from us are considered to be direct marketing), because we think it is important that your interaction with ARONIA-CHARLOTTENBURG.COM exists only as long as you want it.
  8. The right not to be subject to a decision based exclusively on automatic processing, including the creation of profiles, which produces legal effects concerning the data subject or similarly affects him to a significant extent. ARONIA-CHARLOTTENBURG.COM does not make such profiling to be followed by automated decisions with legal or similar effect significant for the data subject. At the time we make such profiling, we will notify you and modify this information note.
  9. The right to submit a complaint to the National Authority for the Supervision of Personal Data Processing. B-dul G-ral. Gheorghe Magheru 28-30, Sector 1, postal code / l 010336, Bucharest, Romania. +40.318.059.211 / +40.318.059.212, anspdcp@dataprotection.ro.

Without identification:

In some cases, we may not be able to search for your personal information due to the identifiers you provide in your request. In such cases, if we are unable to identify you as the data subject, we are unable to comply with your request to exercise your legal rights described in this section, unless you provide additional information to enable you to identify yourself. We will inform you and give you the opportunity to provide such additional details.
